Terms of Service & Privacy Policy

Please read these Terms of Service carefully before using the Quinty.ai website or any related services (collectively, the "Service") operated by Quinty, Inc. ("Quinty," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding contract to use the Service. If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service

Quinty.ai provides an AI-powered platform that enables users to generate content, analyze data, and conduct research. The Service is provided on an "as is" and "as available" basis, and we may modify, suspend, or discontinue features at any time with reasonable notice where practicable.

3. Account Registration

To access certain features, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration;
  • Maintain and promptly update your account information;
  • Keep your login credentials confidential; and
  • Notify us immediately of any unauthorized use of your account.

You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates applicable federal, state, local, or international law or regulation;
  • Transmit or input content that is unlawful, harmful, defamatory, obscene, fraudulent, or otherwise objectionable;
  • Attempt to gain unauthorized access to any part of the Service or its related systems;
  • Reverse-engineer, decompile, or attempt to extract the source code of any software underlying the Service;
  • Use the Service to develop a competing product or service;
  • Engage in automated scraping, crawling, or data harvesting without our express written consent; or
  • Introduce malware, viruses, or any other malicious code.

5. User Content

You retain ownership of any content, data, or materials you submit to the Service ("User Content"). Quinty.ai and its Third-Party AI Providers will not use Customer Data to train, fine-tune or improve any AI models. However, by submitting User Content, you grant Quinty a non-exclusive, worldwide, royalty-free license to use, process, and store only the recommendations, scenarios, implementation and change management plans that Quinty delivered from your data to provide and improve the Service. We do not claim ownership of your User Content. However, Quinty.ai retains ownership of all templates, prompts, frameworks and system components.

You represent and warrant that you have all rights necessary to grant this license, and that your User Content does not infringe any third-party intellectual property rights or violate applicable law.

6. AI-Generated Output

The Service uses artificial intelligence to generate responses and content ("AI Output"). You acknowledge that:

  • AI Output may be inaccurate, incomplete, or not suitable for your particular purpose;
  • AI Output does not constitute legal, financial, medical, or professional advice;
  • You are solely responsible for evaluating and using AI Output; and
  • Similar or identical outputs may be generated for other users.

To the extent permitted by law, Quinty makes no warranty regarding the accuracy, reliability, or fitness of AI Output for any specific purpose.

7. Intellectual Property

All rights, title, and interest in and to the Service — including software, design, trademarks, logos, and documentation — are owned by or licensed to Quinty. Nothing in these Terms transfers any ownership rights to you. Subject to your compliance with these Terms, Quinty grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose.

8. Fees and Payment

Certain features of the Service may require payment. All fees are stated in U.S. dollars and are non-refundable unless otherwise stated or required by applicable law. We reserve the right to modify pricing at any time with reasonable advance notice. Continued use of the Service after a pricing change constitutes your acceptance of the new fees.

All payments are processed by third-party payment processors. You agree to provide accurate billing information and authorize Quinty to charge the applicable fees to your designated payment method.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. QUINTY EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. QUINTY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QUINTY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF QUINTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

QUINTY'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO QUINTY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

11. Indemnification

You agree to defend, indemnify, and hold harmless Quinty and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any applicable law or the rights of any third party.

12. Third-Party Services and Links

The Service may contain links to third-party websites or integrate with third-party services. We do not endorse, control, or take responsibility for any third-party content or practices. Your interactions with third parties are governed by their respective terms and privacy policies.

13. Modifications to the Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page and, where appropriate, notify you by email or through a notice on the Service. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.

14. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease. Sections 5, 7, 9, 10, 11, 15, 16, and 17 will survive termination.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

YOU AND QUINTY EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTION LITIGATION.

16. Severability and Waiver

If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

Quinty, Inc. ("Quinty," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you visit quinty.ai or use our services (the "Service"). Please read this policy carefully.   • Analyze usage patterns and conduct research to improve our AI models and user experience.

We do not sell your personal information. We may share your information in the following circumstances:

Quinty is based in the United States. If you access the Service from outside the United States, your information may be transferred to, stored, and processed in the U.S. or other countries where our service providers operate.
